This website is operated by Aestival Gems. Throughout the website, the terms “we”, “our” and “us” refer to Aestival Gems. By visiting our website and/ or purchasing from us, you engage in our Service and agree to be bound by the following Terms and Conditions ("Terms of Service") referenced herein, and constitute an agreement between you and Aestival Gems. This Terms of Service applies to all users on our website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully.
Aestival Gems reserves the right to change or modify any of these Terms and Conditions or any policy on our website at any time, and in its sole discretion. Any change or modification will be effective immediately upon posting of the revisions on our website. Your continued use of the site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and Conditions and any other applicable policies from time-to-time to understand the terms and conditions that apply to your use of our website. If you do not agree to the amended terms, you must stop browsing on our website.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to set up our online store to sell our products and services to you.
(A) Bespoke Jewellery Service
All of our gemstones are required a full payment to secure the piece before proceeding to our bespoke jewellery service. All bespoke jewellery pieces designed and/or ordered with us will be required an initial payment of 60% Deposit. With this payment, the buyer agrees to let us begin the Computer-Aided Design (CAD) stage of the discussed bespoke jewellery piece. The buyer will be shown a CAD model of the bespoke jewellery piece. When the CAD model is satisfactory to the buyer, the buyer will be asked to provide a signature on the CAD stating he or she approves the CAD design. This approval signifies the buyer's desire for Aestival Gems to commence the next stage for casting as per shown on the approved CAD and that the buyer agrees to pay the agreed-upon total invoice amount as well as the final balance of his or her order, as well as agree to be bound by our Bespoke Jewellery Terms of Service. At the completion of a satisfactory bespoke jewellery piece, we will require the final balance at 40% due before delivery of the bespoke jewellery piece to the buyer.
From the production stage to delivery of final product will take earliest 1 month or latest 2 months to complete.
No modification or cancellation to agreed-upon CAD model can be made after casting has begun. If the 60% Deposit has been made to us, the buyer needs to bear for the initial payment made as the non-recoverable cost for the bespoke jewellery piece. Final and delivered bespoke jewellery piece is non-returnable, non-exchangeable and non-refundable.
At the discretion of Aestival Gems, a bespoke jewellery piece will be repaired if any manufacturer defect is found within a month from the date of the purchase. Manufacturing Defect refers to the structure of the jewellery piece that has to do with the casting, such as the band has separated from its ring head or porosity inside the ring that weaken the ring's ability to hold up to normal wear. Normal wear and tear, and customer abuse are not covered under this said 1-month warranty. It is the buyer's responsibility to provide an accurate ring size prior to production, therefore we cannot be held responsible or liable in the event that the ring size is not fitting as long the size produced is as per the ring size given by the buyer. In the case where the buyer requires a resizing on the final product, the buyer will be asked to pay an extra charge to engage the resizing service (the price will depend upon the quotation from our goldsmith).
(B) Modifications to Our Service and Prices
The prices set on our products are subject to change without any advance notice. Price adjustments may result from market price fluctuation, market value, rarity of specific gemstones, system or typographical errors on inaccurate price displayed and/or other relevant factors when modifying prices. The new pricing will be effective immediately upon modification. We are also reserve the right at any time to discontinue the product/service without notice at any time. We shall not be deemed liable to you or to any third-party services for any modification, price adjustment, suspension or discontinuance of the product/service. We do not negotiate prices on our products and all our prices are final.
(C) Accuracy, Completeness and Timeliness of Customer Information
We shall not be deemed liable on the part where users/customers keyed in their Personal Information and Order Information inaccurately, incompletely or irrelevantly. Any reliance on the information the user/customer has provided on our website is at his or her own discreet. We use the information our user/customer provided to us to communicate, process, bill and ship his or her order. Therefore, it is the user/customer's responsibility to always update his or her information to the latest information.
(D) Changes to Aestival Gems' Terms of Service
Users/Customers on our website can review the most current version of our Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of this Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Any user/customer continued use of or access to our website, and/or our bespoke jewellery service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
(E) Termination
Termination notwithstanding any of these Terms of Service, Aestival Gems reserves the right, without notice and in its sole discretion, to terminate your license to use this site, and to block or prevent future access to and use of our website.
